Terms and Conditions MONETT MAISON

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Entrepreneur: the sole proprietorship MONETT MAISON, registered with the Chamber of Commerce under number 17285477.

Customer: the natural or legal person who enters into an agreement with the entrepreneur.

Agreement: any arrangement between the entrepreneur and the customer regarding the purchase of products or services.

Products: all goods and services offered by the entrepreneur.


Article 2 – Applicability

These terms and conditions apply to all offers, agreements, and deliveries of MONETT MAISON, unless otherwise agreed in writing.


Article 3 – The Offer

All offers made by MONETT MAISON are non-binding and may be withdrawn at any time.

Obvious errors or mistakes in the offer are not binding on the entrepreneur.


Article 4 – The Agreement

The agreement is concluded at the moment the customer places an order and it is confirmed by the entrepreneur.

The entrepreneur reserves the right to refuse orders or request additional information.


Article 5 – Prices and Payment

All prices are in euros and include VAT, unless stated otherwise.

Payment must be made via the available payment methods and within the specified term.

In the event of late payment, the entrepreneur reserves the right to terminate the agreement or charge collection costs.


Article 6 – Delivery and Execution

Delivery takes place while supplies last.

The entrepreneur will exercise the utmost care in processing and shipping orders.

Exceeding the delivery time does not entitle the customer to compensation or termination of the agreement.


Article 7 – Shipping Policy

Delivery

  • Delivery takes place while supplies last.
  • Delivery is made from MONETT MAISON, unless otherwise agreed in writing.
  • Online orders are delivered to the address provided by the customer.
  • If agreed payments are not made or not made on time, MONETT MAISON reserves the right to suspend its obligations until full payment has been received.
  • Late payment constitutes default by the customer, meaning any delay in delivery cannot be attributed to MONETT MAISON.
  • The customer must ensure that delivery of the ordered products can take place in a timely manner.

Delivery Time

  • Delivery times stated by MONETT MAISON are indicative. Exceeding them does not entitle the customer to compensation or termination, unless explicitly agreed otherwise in writing.
  • The delivery period begins once the customer has completed the (electronic) ordering process and received confirmation from MONETT MAISON.
  • Exceeding the stated delivery time does not entitle the customer to compensation or termination, unless MONETT MAISON fails to deliver within 14 days after written notice, or otherwise agreed.

Transport, Packaging and Shipment

  • Transport costs are borne by the customer, unless agreed otherwise in writing.
  • If the packaging of a delivered product is opened or damaged, the customer must have this noted by the delivery person before accepting the product. Failing this, MONETT MAISON cannot be held liable for any damage.
  • If the customer arranges transport themselves, any visible damage must be reported to MONETT MAISON prior to transport. If not, MONETT MAISON cannot be held liable.

Article 8 – Right of Withdrawal

The customer has the right to withdraw from the agreement within 14 days after receipt without stating a reason.

During this period, the customer must handle the product and packaging with care.

Return shipping costs are at the customer’s expense.


Article 9 – Warranty and Conformity

The entrepreneur guarantees that the products comply with the agreement and meet reasonable expectations.

If a product is defective or does not conform, the customer must contact the entrepreneur within a reasonable time.


Article 10 – Liability

The entrepreneur is not liable for indirect damage, consequential damage, or business loss.

Liability is limited to the purchase price of the product.


Article 11 – Force Majeure

In the event of force majeure, the entrepreneur is not obliged to fulfill any obligation towards the customer.

Force majeure includes all circumstances beyond the control of the entrepreneur that prevent fulfillment of the agreement.


Article 12 – Intellectual Property

All intellectual property rights related to the products and website content remain the property of the entrepreneur.

No part may be copied, distributed, or used without prior written consent.


Article 13 – Complaints Procedure

Complaints must be submitted in writing within a reasonable time.

The entrepreneur will handle complaints as soon as possible, but no later than within 14 days.


Article 14 – Applicable Law and Disputes

These terms and conditions are governed by Dutch law.

Disputes will be submitted to the competent court in the Netherlands.
